19 Oct SIC recognizes the notoriety of the trademark “IDIME”.

The Instituto de Diagnóstico Médico S.A with a trajectory in the market of almost 30 years as the holder of the trademark “IDIME”, has recently received the recognition of notoriety for its non-registered trademark by the Superintendence of Industry and Commerce for the distinction of medical laboratory and diagnostic imaging services, comprised in class 44 of the Nice International Classification. This implies that the trademark has very special recognition amongst the Colombian public, hence deserving an enhanced level of protection.

In the list of signs declared as notorious in the first semester of 2022, the Directorate of Distinctive Signs indicated that it found proof that the trademark “IDIME”, has obtained a high degree of recognition among the members of the health sector, and recognizes the advertising effort made by the company to make itself known at a national level, with strategies to position itself competitively in the commerce. This is proven by the continuous growth in sales, the investment in advertising, the intensity of the use of the brand, and its awareness in the market.

Due to the above, although the trademark “IDIME” was not previously registered for the identification of services included in class 44, from now on it will have recognition as a “notorious unregistered trademark”, hence, according to the provisions of Article 136 paragraph H of Decision 486, it will enjoy a higher degree of protection against possible affectations to its distinctive force.
